The opinion of the court was delivered by This was one of several actions resulting from proceedings
instituted in the fall of 1951 by the State Highway Commission
under its powers of eminent domain for the purpose of condemning
several tracts of land, located near the city of Emporia, for
highway purposes. Appraisers were appointed and appraised the
real estate in the condemnation proceeding as provided by law.
A.J. Place and Janice N. Place, the owners of one of the tracts
appraised, appealed from the appraisers' award in the manner
authorized by G.S. 1949, 26-102. Subsequently, the instant action
was docketed in district court as required by that section of the
statute and the cause was tried by a jury which returned a
verdict for a greater amount than was allowed by the appraisers.
